Posted - 10/10/2011 : 07:40:27 AM OK, old and new futs: This will be my last post on this topic (ain't you glad?) because everybody is getting tired of the whole thing. BUT, it ain't every day a friend of mine gets interviewed in the NY Times and then gets to show what 2 1940's Gibsons, identical, except one is rosewood and one is mahogany, sound like. Very nice exit.

PS. Lawrence, John just used a basic Zoom, and he was outside his house, but you can really hear the difference. |

Posted - 10/10/2011 : 06:35:56 AM Yes, it is good to hear from some of the old farts, including commander piffleanimous himself.
Long time since that balcony in S.F.

Posted - 10/06/2011 : 06:37:50 AM Cap'n Mike, you can take it on a plane to CT. Much more moderate in every way.
Now, for a few more facts, ignoring politics. The base issue is one of identifying just what the wood from India was and *encoded* as. I asked John to explain some details to me that the raid was based on - codes. There is some confusion about India regs/harmonized tariff codes (in legal lingo). Here is John's explanation (don't let your eyes glaze over because it is at the heart of the matter): --------------------- Indian law prohibits the export of sawn wood thicker than 6mm, which gets hs code 4707: http://www.eximguru.com/exim/dgft/itc-hs-export-schedule-2/table-b-chapter-44-wood-and-articles-of-wood-wood-charcoal.aspx
India allows export of sawn wood thinner than 6mm, which gets hs code 4708
India also allows the export of parts, which get hs code 9209: http://www.eximguru.com/hs-codes/9209-PARTS-FOR-EXAMPLE-MECHANISMS-FOR.
So, in this case, India classified the wood chunks as parts under 9209, which ain't right. LMI classified them as thinner than 6mm, using 4707, also ain't right. Someone at lmi did slip on one form and accurately describe the stuff as thicker than 6mm, using 4707.
USFW saw this and pounced. It looks like someone was deceptive.
There's any easy fix: India amends its law's, and applies the amended law retroactively. Poof, no issue. ----------------- Everybody still with me - because it is unclear who that deceptive someone was: Indian vendor, LMI, or Gibson, or all 3. NOT UFSW which was doing its job under current law and protocols, going after the current possessor of the wood. Blame your favorite, including the law, or withhold blame.

Posted - 10/02/2011 : 5:59:01 PM so . . . is it safe to take an old guitar with REAL Ivory nut and bridge, abalone inlay, zebrawood fretboard, Brazilian rosewood back and sides and New Zealand kaori top -- on an airplane to India? |

Posted - 09/28/2011 : 3:02:19 PM From the article:
"Industry and environmental experts contend that the seized wood had not been made into fingerboards and was still unfinished, making its export a violation of Indian law."
The exported wood was imported legally by Gibson and blessed India's and the US' customs. It has ZERO to do with forrestation and everything to do with the greed of India. This is a new interpretation. Gibson's been importing from India for a long time. Ric |

Posted - 09/26/2011 : 07:16:32 AM Yes, I absolutely agree Retro. I'll debate you offline though if you like. It would be interesting to get the perspective of an American who seems to think my country is too conservative. Very interesting. We could start with the revolving-door judiciary system for repeat-offender violent criminals, and move on from there.
Aloha and sorry for the heat -
Mike. |

Posted - 09/25/2011 : 6:24:27 PM Enough, Mike. This is primarily a music-topic discussion group, not a Canadian-political one. And trust me, I am one of those rare Americans who actually pays attention to Canadian politics, culture, history, and so on, so I could easily get engaged with you in a lengthy debate on these points - but Taropatch is NOT the place for it, agreed? |
